Terms of Service of the Gartenstadt Hotel

1. Conclusion of a contract

1.1 The accommodation contract is concluded as soon as rooms, premises and other services have been promised. The hotel is free to confirm the room booking.

1.2 The conclusion of the accommodation contract obliges the contracting parties to fulfill the contract, regardless of the duration of the contract. The concluded contract can only be terminated for an important reason. If a third party has ordered for the customer, he and the customer are jointly and severally liable to the hotel for all obligations arising from the hotel accommodation contract.

2. Arrival and departure

2.1 Unless otherwise agreed in writing, reserved rooms are available to the guest from 3 p.m. on the day of arrival and must be vacated by 11 a.m. on the day of departure.

2.2 The reservation dates are binding for both contracting parties. Reserved rooms are only available to the service recipient for the agreed period. Use of the reserved rooms beyond the agreed period requires the consent of the hotel. If you plan to leave after 11.00 a.m., you must notify the reception by 9.00 p.m. the previous evening at the latest.

3. Services

3.1 The customer is obliged to pay for the room provided and the other services used by him. This also applies to services and expenses of the hotel to third parties initiated by the customer.

3.2 The guest does not acquire the right to be provided certain rooms or premises. If the agreed premises are not available, the hotel is obliged to try to find an equivalent replacement in the house. The contractual scope of the hotel’s services results from the agreements made in writing.

3.3 If rooms or other services are reserved on an option basis, the option dates are binding for both parties. After the agreed option period has expired, the hotel can freely dispose of the rooms and services booked for options without consulting.

3.4 Unless otherwise agreed in writing, the prices are per room and night including VAT. Any increase in VAT after the contract has been concluded is at the expense of the service recipient. Agreed prices can be changed by the Gartenstadt Hotel after the conclusion of the contract according to the then valid prices without prior notice if there are more than 6 months between the conclusion of the contract and the provision of the service.

4. Payment

4.1 The fee for the booked services is due at the latest upon departure of the guest. The hotel is entitled to demand advance payments at any time in the amount of the total expected accommodation price after the conclusion of the accommodation contract. In order to guarantee a reservation and for the resulting services, the hotel may request a valid credit card number from a credit card company accepted by Gartenstadt Hotel.

4.2 In the event of a longer stay, Gartenstadt Hotel is entitled to issue individual interim bills, e.g. in the form of weekly bills, and to request payment from the guest.

4.3 Interim invoices are payable by the guest immediately upon receipt. If the guest is in default of payment, the hotel can cancel the agreement with immediate effect. The hotel reserves the right to assert further costs, in particular the failure to rent to other parties. Invoices to companies, travel agencies, etc. will only be issued if the hotel, by the invoice recipient, has submitted a written cost assumption declaration on their official business paper and this is accepted by the hotel. Such invoices are payable within fourteen days of the invoice date, without deduction and in the currency shown on the invoice. The place of performance for the guest’s payment obligations is the hotel’s registered office. This also applies if the guest has been credited with the payment.

4.4 The Gartenstadt Hotel is free to accept and select credit cards in each individual case, even if the general acceptance of credit cards is indicated by notices in the hotel. Checks, credit cards and other means of payment are only accepted on account of performance.

4.5 Prices for groups are only valid on the basis of separate written agreements. The hotel is entitled to make the reservation dependent on a deposit. In the case of group reservations, the hotel reserves the right to reduce the quota of unused rooms and / or to change the agreed price if less than 75% of the agreed rooms are used.

5. Cancellations

5.1 In the case of changes or cancellations of reserved hotel rooms and arrangements, the following may be invoiced: a) Up to 6 weeks before arrival, no costs. b) Up to 2 weeks before arrival, 50% of the agreed services. c) Less than 2 weeks before arrival, 80% of the agreed services. The hotel describes a reservation as a group reservation with a number of people from 15.

5.2 For individual reservations: No costs for cancellations made up to 48 hours before arrival. In the case of overnight stays that have not been used, canceled or canceled too late, the accommodation costs will be invoiced minus any services not provided (e.g. breakfast). It is irrelevant whether the hotel is fully booked or not. All cancellations must be made in writing. The above cancellation fees are reduced by the amounts obtained by subletting the canceled room or charging the service.

6. Liability

6.1 The guest or the organizer are liable to the Gartenstadt Hotel for any damage caused by them or their guests.

6.2 The hotel is not liable to the guest or the contractual partner if the provision of services becomes impossible in the event of a strike or as a result of force majeure. In these cases, the Gartenstadt Hotel will endeavor to procure equivalent services elsewhere.

6.3 The hotel is liable to the guest according to the provisions of the German Civil Code (up to 100 times the room price, a maximum of € 3000 for money and valuables in accordance with Section 702 of the German Civil Code, but only up to € 750, unless the Gartenstadt Hotel or its staff is at fault or the valuables or the money were given to the hotel for safekeeping in exchange for a receipt.
